New Waste Management (Collection Permit) and (Facility Permit) to be introduced.
Waste Management (Collection Permit) Regulations 2007
The Minister for the Environment, Heritage and Local Government has recently signed the Waste Management (Collection Permit) Regulations 2007
The Regulations, which come into effect on 31 March 2008 amend and replace the Waste Management (Permit) Regulations S.I. 402 of 2001. They set out requirements for making a permit application. They also define public consultation requirements and how the Local Authority deals with the various aspects of the application and any submissions made.
The primary purpose of these Regulations is to place controls on waste activities for the purposes of environmental protection and to facilitate the implementation of, and achievement of relevant objectives in, waste management plans.
All those involved in the production, collection, movement and acceptance of waste should be aware of the provisions of these regulations.
Producers of waste may only give waste to collectors who are suitably permitted. Those who collect may only do so if they have secured the proper permits required for that purpose. Those who accept waste can only do so if the person transferring the waste to them is authorised to do so.
Key changes to Waste Management (Collection Permit) Regulations 2008
§ Provides operators with the option of applying for a permit for specified regions or multi regions by means of a single application to a single Nominated Authority.
§ Extend the time period for a collection permit from 2 to 5 years.
§ Empower Local Authorities to recover all or part of the reasonable costs incurred by them in ongoing monitoring of compliance with a collection permit, including the costs of inspections and investigations.
§ Provides for conditions to be attached to collection permits specifying the requirements to be complied with in respect of the types and quantities of wastes collected and the place or places to which waste concerned may or shall be delivered for recovery or disposal.
§ Local authorities have the absolute discretion to refund or waive all or part of the fees payable where it is satisfied that the payment of the full fee would not be just and reasonable having regard to the limited nature or scale of the activity concerned or where the charging of the full fee would act as a disincentive to companies or individuals who are operating on a small scale or are engaged in environmentally beneficial operations such as waste recovery or recycling
§ Empower Local Authorities to revoke a collection permit.

Waste Management (Facility Permit and Registration) Regulations 2007
The Minister for the Environment, Heritage and Local Government has recently signed the Waste Management (Facility Permit and Registration) Regulations 2007.
The Regulations, which come into effect on 31 March 2008, amend and replace the Waste Management (Permit) Regulations, S.I. 165 of 1998. They set out requirements governing the issueing of Permits and Certificates of Registration by Local Authorities of waste facility activities.
They also deal with consideration by Local Authorities of submissions in relation to Permit or Registration applications. The purpose of the Regulations is to facilitate recovery activities to the greatest extent practicable while ensuring enviromental protection. They also reduce the administrative and cost burdens of applicants for certain smaller waste recovery operations .
These regulations give powers to Local Authorities to attach conditions governing the use of mobile plant operating at more than one facility. Facilities must now assist with achieving the objectives of Regional Waste Management Plans and the National Hazardous Waste Management Plan. There is also a need for a facility to ensure sound environmental management of waste and to encourage waste prevention, re-use, recycling and recovery.
Key changes: to waste Management (permit) Regulations
- The different classes of activity for Waste Facility Permits and Certificates of Registration have been defined.
- The timescales to be adhered to upon receipt of valid applications are defined.
- Permits may be reviewed, revoked, transferred and decisions made may be appealed to a competent court.
- Procedures to deal with abandoned applications are dealt with.
- Planning permission or a certificate of exemption must be obtained for all permitted activities.
- If there is no authorisation of any kind on an activity even if it is for land reclamation it will be counted as landfilling and the landfill levy applies. This levy will have to be channelled through each individual Local Authority for transmission the DoEHLG.
